I. 目的
A. The purpose of this 员工申诉调解程序 (“Procedure”) is to implement the 员工申诉政策 (“Policy”) of Anne Arundel 社区 College (“College”).
B. This Procedure sets forth the process for employees to use mediation to resolve issues without needing to use the Formal Grievance Process, 经双方同意.

1. Mediator is a neutral third party who attempts to facilitate the Parties to resolve an issue prior to or after submitting a Grievance, and has no advisory or determinative role in regard to the content of the dispute or the outcome of the resolution.

A. At any time before or after the Grievance Form is filed and before the conclusion of Formal Grievance Process, the Grievant or Respondent may submit a 中介形式 to the CCFPO or designee to request the assistance of a Mediator to resolve the Grievance.
B. 即使人际纠纷并不令人伤心, an Employee may request 中介 to assist in resolving interpersonal disputes with another Employee by submitting the 中介形式, 包括要解决的问题的描述.
C. 如果先前已提出申诉, the filing of a 中介形式 will automatically stay all the applicable deadlines in the Formal Grievance Process until 中介 is completed or ended by one or both of the Parties.
D. 同意
1. The CCFPO or designee will submit the 中介形式 to the other Party to request consent to mediation.
2. The other Party will state whether they consent on the 中介形式 and return the 中介形式 to the CCFPO or designee.
3. 如果另一方同意, the CCFPO or designee will notify the Party who requested 中介 and Decision Maker and proceed with 中介. 如果另一方不同意, the CCFPO or designee will notify the other Party that the 中介 will end and the Formal Grievance Process will continue.
4. 如在调解期间的任何时间点, 任何一方希望撤回对调解的同意, 当事人必须通知调解员, and the Mediator will mark the 中介形式 unresolved due to withdrawal of consent and submit it to the CCFPO or designee who will notify the other Party.

E. 委任调解员

a. Has previous experience or training in conducting mediation; and

F. The Mediator will be required to sign the 调解员保密声明表.
G. The Mediator will contact both Parties and schedule a 中介 conference to occur within fifteen (15) Business Days of the date on which the Mediator was appointed.
1. The Mediator will advise on or determine the process of 中介 whereby resolution is attempted.
2. The Mediator may request written statements or summaries from both Parties and may contact other persons for information, 由调解员决定.
3. Information received by the Mediator shall be treated confidentially and shared only on a “need to know” basis and may not be shared with any individual who may be a Decision Maker at any Step.
4. Statements or summaries prepared especially for the 中介 and any notes taken by the Mediator will not be considered in subsequent Steps and are not part of the Record.
H. If the initial 中介 conference does not result in a resolution acceptable to both Parties, 如果双方同意, 调解员可以 schedule subsequent 中介 conferences for up to but not exceeding forty (40) Business Days from the date on which the Mediator was appointed.
I. 一方或双方未能出席预定的调解会议, 调解员可以, 但不是必须的, 重新安排一次会议, provided the new date is within fifteen (15) Business Days of the date the initial conference was scheduled.

1. Both Parties must sign the completed 中介形式 and send the signed copy to the Mediator.

K. If the 中介 does not result in a resolution acceptable to both Parties, the Mediator will mark the 中介形式 as unresolved and submit it to the CCFPO or designee and the Parties within two (2) Business Days of determining that the Parties cannot reach an agreement but will offer no conclusions or opinions regarding whether the Grievance has merit.
L. 收到调解员的调解表格后, the CCFPO or designee will notify the Parties and if a Grievance is pending, the Decision Maker at the Step that was under consideration at the time the 中介形式 was submitted, 说明:
1. The 中介 resulted in a resolution and the Grievance is concluded; or
2. 调解没有产生解决方案. 如果申诉悬而未决, the Formal Grievance Process will continue at the Step that was under consideration when the 中介形式 was submitted, and the CCFPO or designee will provide revised dates for any applicable deadlines to the Parties.
